Do I need an Employment Contract with my Nanny?
It is highly recommend that every employee have a contract in place. This clearly outlines expectations and specifies the procedures to follow in the event of termination.
Is my Nanny an independent contractor or an employee?
It is quite common for families to pay their domestic workers an hourly rate without addressing superannuation, PAYG tax, or other tax obligations. This often occurs when the worker claims to have an ABN and operates as an independent contractor. However, this is typically not an approach you should endorse.
The Australian Taxation Office (ATO) provides guidelines to determine whether a worker is classified as an employee or contractor. A domestic worker is generally considered an employee if they:
(i) are paid for time worked;
(ii) are responsible for providing their own materials or equipment;
(iii) must carry out the duties of their role;
(iv) agree to provide their personal services; and
(v) have set working hours based on mutual agreement.
Based on these criteria, it’s evident that the ATO would typically classify your domestic worker as an employee. After all, you likely wouldn’t want your worker to dictate their own work hours.
If you are paying workers "cash in hand" to bypass these obligations, this is illegal and removes important protections for both you and your employee. Furthermore, it may negatively impact your worker's ability to secure credit or extend their right to work in Australia.
